The website offers features to book a vehicle online and schedule a test ride for a vehicle, which by law has minimum age criteria of 18 years. Additional features and services (as offered by VERB through the website(s)) such as e-KYC, online insurance, online finance, completing the vehicle purchase by making online payment, or any other features and services being or to be offered through the website(s) or third party agencies or vendors, by law will have minimum age criteria of 18 years. Use of this website is allowed only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you are not eligible to use the website and may only use the website with the involvement of a parent or guardian.

- The prices given are valid for the moment for online booking only. The Prices applicable from dealers may be different from location to location.

- The prices are subject to change without prior notice & the price prevailing at the time of delivery will be applicable if no booking amount is given.
- All Payments By way of RTGS/NEFT/IMPS/DD/UPI are to be made in favor of "HOMETECH ELECTRONICS PVT LTD” only.
- VERB/HOMETECH ELECTRONICS PVT LTD. Will not take any responsibility for VERBAL / ANY commitments made by any of its employees, other than Authorized Signatories mentioned below.
Warranty Terms & Conditions
- VERB PRODUCTS ARE COVERED UNDER 24 MONTHS FROM DATE OF PURCHASE BY THE CUSTOMER or explicitly mentioned in the user handbook/ warranty card given with the product.
- Warranty is subject to item be not damaged and not handled by an unauthorized service personnel.
- No warranty on electrical items, cables & chargers.
- The customer is advised to read the operating and service manual supplied with the product and follow the guidelines.
- In case the customer does not follow the guidelines and misses routine advised service checks the warranty will not be applicable.
- In case the EV is repaired, serviced, handled by any unauthorized person, or resold, the warranty will be ceased to exist.
Fair usage by User
User agrees that this website is an online platform to browse products, request a test ride at a dealership, book a product online at a dealership, complete vehicle e-KYC, purchase insurance, opt for financing, make payment for purchase online and associated features, which may be periodically enhanced, amended, corrected to improve customer experience. User warrants that he/she is not disseminating malicious code or deploying bots to the website. The user is responsible for ensuring their browser / operating system is up-to-date and free from viruses.

4. USER RESPONSIBILITY AND REGISTRATION OBLIGATIONS
b) If VERB terminates your use of the Website or any service therein, VERB may delete any content or other materials relating to your use of the Website and will have no liability to you or any third party for doing so. In case you have created a login for the website, you are solely responsible for maintaining the confidentiality of your user ID/your account/display name and password and for restricting access to your computer or any other device used to access the website to prevent unauthorized access to your account and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner. You agree to accept responsibility for all activities that occur under your account and password. Users can also deregister and delete accounts from the website with or without cause /reason.

You agree, undertake, and confirm that your use of the Website shall be strictly governed by the following binding principles:
1) You shall not host, display, upload, modify, publish, transmit, update, or share any information which:
i. belongs to another person and to which you do not have any right to use;
ii. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic or menacing, libellous, invasive of another's privacy, hateful, racial, ethnically objectionable, disparaging, relating or encouraging money laundering, gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986 is misleading in any way;
iii. is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred, or physical harm of any kind against any group or individual;
iv. harasses or advocates harassment of another person;
v. involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";
vi. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libellous;
vii. infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address, or phone number), or rights of publicity.
viii. promotes an illegal or unauthorized copy of another person's copyrighted work (see "Intellectual Property Right Complaints" below for instructions on how to complain about uploaded copyrighted material), such as providing pirated computer programs or links.
ix. contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
x. provides material that exploits people in a sexual, violent, or otherwise inappropriate manner or solicits personal information from anyone;
xi. provides instructional information about illegal activities, violating someone's privacy, or providing or creating computer viruses;
xii. contains video, photographs, or images of another person;
xiii. tries to gain unauthorized access or exceeds the scope of authorized access to the Website or profiles, blogs, account information, bulletins, or other areas of the Website or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
xiv. interferes with another user's use and enjoyment of the website or any other individual's user and enjoyment of similar services;
xvi. harm minors in any way;
xvii. infringes any patent, trademark, copyright, trade secret, or other proprietary rights of VERB or any third party;
xviii. violates any law for the time being in force;
xix. deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing;
xx. impersonate another person;
xxi. contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any Trojan horses, worms, time bombs, cancelbots, Easter eggs, or any other computer programming routines that may damage, detrimentally interfere with, diminish the value of, surreptitiously intercept or expropriate any system, data or personal information.
xxii. threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense, or is insulting any other Nation;
xxiii. shall not be false, inaccurate, or misleading;
xxiv. shall not, directly or indirectly, offer, attempt to offer, trade, or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation, or guideline for the time being in force;
xxv. shall not create liability for us or cause us to lose (in whole or part) the services of our internet service provider ("ISPs") or other suppliers;
2) If you believe that any content on the Website is affected due to the above points, you shall immediately notify us in writing. VERB will make all reasonable endeavors to remove such content complained about within a reasonable time.
3) Any non-compliance with the use of the website would be dealt with as per the policy.
6. ELECTRONIC COMMUNICATIONS
When you visit the website or send e-mails to us, you are communicating with us electronically. We may communicate with you by e-mail, SMS, phone call, or by posting notices on the website, or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional, and/or commercial messages) from us for your use of the website.
7. INTELLECTUAL PROPERTY RIGHTS/ TRADEMARK, COPYRIGHT, AND RESTRICTION
All content included on the website, such as text, graphics, logos, button icons, images, and audio clips, digital downloads, data compilations, and software, is the property of VERB and/or, its affiliates or its content suppliers and is protected under trademark and copyright laws and other relevant law(s) as applicable from time to time.
You shall not extract or re-utilize parts of the contents of the website without VERB and/or its affiliates (as may be applicable) In particular, you shall not utilize any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilization of any parts of this website. You shall also not create and/ or publish your database that features and/or substantial (e.g.: prices and product listings etc.) parts of this website.

9. PRODUCT COMPLIANCE
Products displayed on the VERB website are manufactured/ procured as per the applicable Local Laws of India and conform to the required Indian industry standards. While we take utmost care to provide the most accurate information to our users on the website, VERB does not warrant that product/vehicle names, descriptions, prices, images, or other content of the website is accurate, complete, reliable, updated, or error-free and assumes no liability in this regard. The user shall validate the exact product specifications and associated information by visiting the selected dealership in person. The product information and details provided on the website are for personal, non-commercial use only.
- Online Booking
VERB provides a platform for customers to view products, request a test ride, and book a product online and associated features, which may get enhanced and amended regularly for improved customer experience and for removal of any defects from time to time.
It may be required to provide a One Time Password (OTP) verified mobile number and OTP verified email address while making an online booking. Verified mobile number and email ID are required for important communication from VERB, your selected dealership, and our authorized third-party partners such as insurance and finance services that you may choose to avail of.
While booking online, a customer must agree to provide acceptable documents like identity proof and local address proof of the selected city for RTO registration. If the customer fails to provide acceptable identity and address proof documents, the customer shall be intimated by the dealership and the dealership may cancel the booking. In the event of cancellation, the cancellation charges as displayed on the cancellation page shall be applicable.
The booking shall be deemed as made/ effective only upon receipt of the specified booking amount paid by the customer through the online payment mode.
During online booking, if the booking amount is deducted by the customer’s issuer bank but is not received by the payment service provider, the customer’s booking shall remain pending until the payment is received. Failure to receive the payment will result in the cancellation of the pending booking and if any money is deducted from the customer’s account, it would get refunded in 7 working days through the same mode of payment used during the booking. In such cases, customers can book a vehicle online again or visit the dealership physically.
At the request of the dealership or VERB, the customer shall produce the booking details sent to their email address and mobile number registered on the website to process the booking.
- Payment Policy
The Payment of the booking amount for a vehicle, and the final amount (comprising of any third-party services availed by the customer online) shall be made via the selected Payment Gateway. There might be additional payment (towards offline purchases or any differential amount during the final invoice) to be made directly by the customer to the dealership, as applicable. The amount for the selected vehicle would be displayed in the product details before making an online payment.
The payments made by customers for online booking are credited by the payment gateway service provider to the selected dealership directly, after deducting gateway charges and applicable taxes.
The payments made by the customers for online booking are adjusted in the final net amount of the vehicle at the time of making the final payment to the selected dealership.
The Payment Gateway shall have the discretion to charge a specified fee for this service and VERB or its dealership holds no responsibility for any such charges levied by the Payment Gateway.
While booking a vehicle online, if money is deducted from the customer’s account and booking is not confirmed due to any technical or unforeseen reasons, the money deducted shall usually get refunded within 7 working days in the same mode of payment used during booking. If the refund is not processed by the issuer bank, the customer shall be required to follow up with their bank directly with the payment details shared through email by the payment gateway partner.
VERB, dealerships, and its partner service providers do not receive and shall not store the payment details including debit/credit card details or net banking details of the customer submitted through the payment gateway provided on the website.
- Booking Modification / Change a booked vehicle
Customers shall be allowed to change a booked vehicle to any other vehicle, as available, within the same dealership where they made the original booking. Customers can change a booked vehicle only until they make a final net payment to the dealership.
When the final net payment has been made by the customer to the selected dealership, either online or physically at the dealership, no modification/change in the booked vehicle shall be permitted.
In case the booking amount for a changed vehicle is higher than the originally booked vehicle, the customer shall be required to make the additional payment online, i.e. the positive difference between the booking amount of the new vehicle and the already booked vehicle, to confirm the modification of the booking.
Only upon receipt of the additional payment by the selected dealership and upon e-mail confirmation of the modification of the booking to the customer, the original booking shall stand amended.
In case the booking amount for a changed vehicle is lower than the originally booked vehicle, the difference amount shall be adjusted by the selected dealership at the time of final net payment.
- Booking cancellation and Refund Policy for booking amount
Customers can cancel a vehicle booked until they make a final net payment to the dealership. When the final net payment has been made by the customer to the selected dealership, either online or physically at the dealership, no cancellation shall be permitted.
On cancellation of a successful booking, a cancellation charge shall be levied. The cancellation charge would depend on the selected vehicle and would be displayed at the time of booking as well as during the cancellation of a booking. VERB and its dealerships reserve the right to revise the cancellation charges without prior notice or communication.
Scheduled Test Ride/Document inspection/e-KYC
Test rides may be available to schedule online at select dealerships for the convenience of the customer. The test ride so scheduled is not a contractual commitment and the dealership may at its sole discretion decide to deny or cancel the test ride scheduled without assigning any reason.
Customers shall be required to visit the dealership for inspection and verification of original documents required for registration after uploading KYC documents on the website. The same may be required for loan approval or other third-party services/products availed. The dates, if scheduled, are not contractual commitments and may be changed or rescheduled by the dealership at its sole discretion.
- Final Pricing, Product, and Invoice
The prices displayed on the website at the time of booking are subject to change. The customer may make the balance payment online or directly to the selected dealership as applicable on the date and time of the invoice. Balance payment receivable is on-road price post deduction of the booking amount paid and finance amount adjusted for the amount approved/received from the financer.
If the customer applies for finance through any offline financers, the customer shall submit the finance sanction letter directly to the selected dealership, upon receipt of approval at the dealership, the customer shall make the final payment online or directly to the dealership.
The final invoice shall reflect the actual prices/ charges as on the date of the invoice i.e. the ex-showroom price, the insurance charges, the finance charges (for the loan, if any), the applicable RTO registration, smart card charges, Govt. subsidies (implicit or explicit), if applicable, handling charges or other optional costs and their respective taxes.
The final invoice will be generated by the dealership upon receipt of the final net payment equal to the on-road price of the vehicle. The customer shall make the payment for any differential amount arising due to revision in vehicle prices or any other extra-ordinary, unforeseen and unavoidable circumstances.
Any difference between the amount paid by the customer and the amount invoiced by the Dealership through the final invoice shall be made good by the customer or the Dealership, as the case may be. The amount mentioned on the final invoice shall be treated as final and the Dealership shall reserve the right to deliver the vehicle only upon receipt of the final net payment as per the final invoice.
VERB reserves the right to make changes in the product, including the withdrawal of a product from the market, without prior intimation to the Customer. The customer is free to change his/her selection to any other available product at the selected dealership or cancel the booking.
- Government Subsidy
The central government (FAME-II) and state subsidy benefits, if any, as applicable for an eligible vehicle and/or eligible customer, as submitted and claimed by VERB or its authorized dealership, as per respective government guidelines, shall be adjusted at the time of customer invoice, subject to receipt of approvals from respective government departments.
The customer shall provide an undertaking about eligibility towards FAME-II and/or state subsidy and declare upfront his eligibility for subsidy as part of the documents for sale. Further, the customer shall comply with the requirements of subsidy such as OTP verification of Aadhaar linked phone number and any other requirements as specified by the Government of India / State Government for subsidy. Failure to provide such documentation and required verification or rejection by the Government department of the said customer documentation shall result in the removal of the subsidy amount in the sale price of the vehicle/ obligate the customer to refund the subsidy amount to the dealership.
The dealership has the right to reject the subsidy documents or take a no-interest refundable deposit against the subsidy, refundable upon the approval of the subsidy by the respective government. The dealership has the right to demand payment of the subsidy amount in full from the customer, in case the government rejects the subsidy and the dealership shall be entitled to receive the refund of the full subsidy amount from the customer. The government rejection of the chassis number is adequate evidence of cause.
For the states where subsidies are to be claimed by the customer, the required documents shall be issued/provided by the Dealership during vehicle delivery and the customer shall directly claim the benefits from the respective state government departments, as per the process defined by the respective State Government.
- Vehicle Registration, Delivery, and After Sales Service
The registration of the booked vehicle shall take place from an RTO associated with the dealership selected by the customer and the customer shall need to travel to the dealership premises at their own expense for verification of documents and delivery of the vehicle.
The obligation of providing/uploading acceptable local address proof for registration through an RTO situated in the city of the dealership selected by the customer shall solely lie upon the customer. VERB and/or the selected Dealership are under no obligation to fulfill the sale of a vehicle in the absence of complete and acceptable documents.
In the event of incomplete, incorrect, or unacceptable documents uploaded/provided by the customer, VERB and/or the selected Dealership shall have the discretion to reserve their right to cancel the booking and retain Cancellation Charges to cover its inventory and/or any other administrative costs as incurred while processing the booking.
Customer shall have the obligation to produce acceptable and verifiable address proof (contact Dealership / see FAQ for a list of acceptable documents) for registration at the time of submission. The customer acknowledges the right of the Dealership to cancel the booking if the documents are incomplete, incorrect, or unacceptable for any other reason as may be specified.
The delivery of the vehicle booked via the online portal shall take place at the dealership premises as selected by the customer while booking the vehicle. The customer shall need to make their arrangements at their own expense to take the delivery from the selected Dealership outlet.
The customer shall visit a dealership for delivery of the vehicle after receiving notification of the completion of registration and communication from the dealership about the readiness of a vehicle for delivery. Whilst every attempt shall be made by the dealership to adhere to a confirmed delivery schedule, the dealership at its sole convenience may reschedule delivery without assigning any reason for the same.
The promised delivery timeline, if any, of the vehicle booked via the website shall be the sole responsibility of the Dealership selected by the customer. VERB disclaims any liability arising out of any such change, advance, or delay in the delivery timeline.
After-sales service for a vehicle purchased is available at the dealerships listed on the website. To avail of any after-sales service from the listed dealerships, the customer shall need to make their arrangements at their own expense to reach the after-sales facility of the dealership. Customers shall be required to bring in the vehicle at their own expense to the dealership aftersales facility (service facility) to avail of any after-sales service.
- Manual Booking
The customer may opt for a manual booking process at their preferred dealership. If the customer chooses a manual process of booking, no online entry would be possible for that transaction and all the process would be done manually at the selected dealership. All transactions would need to be conducted by the customer directly with the dealer without the assistance or use of the online system. No details of offline transactions between customer and dealership will be available for the customers using an online platform.
These terms and conditions shall apply to the sale of all VERB products even if purchased offline.
- Dispute Resolution, Applicable Law, and Jurisdiction
Any dispute arising out of a booking made via the website shall be dealt with according to company policy. The courts at Pune, Maharashtra shall have the exclusive jurisdiction to deal with any dispute arising out of any transaction made via the website.
19. WARRANTIES & LIABILITY
- All information, content, materials, products (including software), and other services included on or otherwise made available to you by VERB are provided on an AS IS and AS AVAILABLE basis, unless otherwise specified in writing. You expressly agree that your use of the website is at your sole risk.
- VERB does not warrant that this Website will be uninterrupted, error-free, constantly available, or available at all or that any information on this Website is complete, true, accurate, or non-misleading. Further, VERB shall not be held responsible for the non-availability of the Website during periodic maintenance operations or any unplanned suspension of access to the website that may occur due to technical reasons or for any reason beyond VERB’s control. The user understands and agrees that any material and/or data downloaded or otherwise obtained through the Website is done entirely at his/her discretion and risk and he/she will be solely responsible for any damage to his/her computer systems or loss of data that results from the download of such material and/or data.
- We will not be liable to you in any way or about the contents of, use of, or otherwise in connection with the Website. You acknowledge, by your use of this website, that your use of this website is at your sole risk; that you assume full responsibility for all risks associated connection with your use of this Website.
- Though VERB shall make all endeavors to protect its websites from any viruses, unauthorized access, modification, deletion, unplanned downtimes, cyber-attacks, or other illegal use of its website, however, we do not warrant that this site; information, content, materials, product (including software) or services included on or otherwise made available to you through the Website; its servers; or electronic communication sent from us are free of viruses or other harmful components. Nothing on the Website constitutes or is meant to constitute, advice of any kind.
- VERB will not be liable for any damages of any kind arising from the use of the website, or any information, content, materials, products (including software), or the failure of performance, error, omission, inaccuracy, interruption, deletion, defect or delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access, or alteration, included on or otherwise made available to you through the website, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing. You specifically acknowledge that VERB is not liable for the defamatory or offensive or illegal conduct of other users or third parties and that the risk of injury from the foregoing rests entirely with you.
- You hereby expressly release VERB and/or its management, affiliates, and/or any of its officers and representatives from any cost, damage, liability, or other consequence of any of the actions/inactions of the vendors and specifically waiver any claims or demands that you may have in this behalf under any statute, contract or otherwise.
- Any breach of any applicable laws shall also result in, without prior notice, immediately limiting your activity, removing your information, temporarily/indefinitely suspending or terminating or blocking your login, and/or refusing to provide you with access to this Website.
22. LIMITATION OF LIABILITY

The failure by VERB to enforce at any time or for any period any one or more of the terms or conditions of the Agreement shall not be a waiver by VERB of them or of the right any time after enforcing all Terms and Conditions of this agreement.
